Claims to Pension or Family Pension under CCS (Pension) Rules, 2021 — DoP&PW Clarification

NEW DELHI: Department of Pension & Pensioners’ Welfare (DoP&PW) under the Ministry of Personnel, Public Grievances & Pensions has issued an important clarification regarding claims to pension and family pension under the Central Civil Services (Pension) Rules, 2021.

The Office Memorandum, dated 30th October 2025, reiterates that any claim for pension or family pension shall be governed by the provisions of the rules in force at the time when a Government servant retires, is retired, discharged, allowed to resign, or dies, as the case may be.

As per Rule 5 of the CCS (Pension) Rules, 2021, the date on which a Government servant retires or dies will be treated as a completed working day. Similarly, if the official was on leave, suspension, or otherwise absent immediately before retirement or death, the date of such event will be considered part of that period.

The DoP&PW has instructed all Ministries, Departments, and Organizations to ensure strict compliance with these provisions and to bring the clarification to the notice of all concerned administrative authorities.

This clarification aims to ensure uniform interpretation and implementation of pension entitlement rules across Central Government offices and to prevent ambiguity in processing retirement and family pension claims.

The Office Memorandum was issued with the approval of the competent authority and signed by Smt. Madhu Mankotia, Under Secretary to the Government of India.
