Compulsory Retirement – Pension/Service Gratuity under Rule 44 of CCS (Pension) Rules, 2021: DoP&PW O.M. Dated 30.10.2025

NEW DELHI: Department of Pension and Pensioners’ Welfare (DoP&PW) has issued an Office Memorandum (O.M.) on 30th October 2025, clarifying the provisions related to Pension and Service Gratuity for government servants who are compulsorily retired from service under Rule 44 of the Central Civil Services (Pension) Rules, 2021.

According to the O.M. (F. No. 38/10(03)/2025-P&PW(A)), the following provisions apply:

1. For employees with 10 years or more of qualifying service:
   They will be eligible for Compulsory Retirement Pension under Rule 40.
   The amount of pension will be a portion or percentage of the superannuation pension as may be sanctioned by the competent authority.
2. For employees with less than 10 years of qualifying service:
   They will be entitled to Compulsory Retirement Service Gratuity,
   calculated as a portion or percentage of the superannuation service gratuity, as sanctioned by the competent authority.

The memorandum further instructs all Ministries and Departments to ensure compliance and bring these provisions to the notice of all concerned officers.

The circular has been issued with the approval of the competent authority and signed by Ms. Madhu Mankotia, Under Secretary to the Government of India.
